Fixation of Pay of All India Services on the grant of proforma promotion

Sub: Fixation of Pay of All India Services on the grant of proforma promotion - regarding.

The undersigned is directed to refer to this Department’s instructions regarding fixation of pay of All India Service Officers on grant of proforma promotion, issued vide letter No. 14021/5/2008-AIS-II, dated 29.09.2008,wherein it is provided that:

‘In case an IAS officer on deputation to a post gets promoted in his cadre to a post in a higher grade, his pay in the pay band will be fixed with 
reference to the pay in the pay band of the officer immediately junior to him in the cadre of his service. However, the officer in question would continue to draw the grade pay attached to the deputation post for the remaining duration of the deputation.”

2. However, in certain cases, it has been noticed that the pay of All India Service Officers, on grant of proforma promotion to a higher grade in the parent cadre, has been fixed with reference to the pay of a junior in the cadre who was already drawing more pay than the senior officer even before promotion on account of greater length of his service. It has also been noticed that officers, who get proforma promotion in relaxation of Next Below Rule in terms of DOPT O.M. No.8/8/84/Estt.(Pay. I), dated 15.07.1985 as no immediate junior is available for appointment to the higher grade against an available vacancy in the cadre, have sought to get their pay fixed with reference to the pay of a junior in the cadre who has not even been promoted to the higher scale in which they have got proforrna promotion.

3. The matter has been examined in consultation with the Ministry of Finance, Department of Expenditure and it s clarified that fixation of pay on  grant of proforma promotion with reference to the pay of junior only means that the pay in pay-band or pay-scale may be fixed in terms of normal rules applicable in the case of fixation of pay of junior in State cadre by grant of one increment @ 3% of basic pay, subject to the maximum of pay band-4 or the pay scale. However, where the deputation post is in any pay band with a grade pay, the grade pay would remain unchanged and where the deputation post is in a pay scale, the pay scale would remain unchanged.

Subject: Notional fixation of pay to officers included in the Deputy Secretary Select List 2009 and 2010 reg.

As per DPC guidelines promotions are effective from a prospective date. However, in the case of Central Secretariat Service. Select Lists for the Selection Grade (Deputy Secretary) for certain years got delayed due to protracted litigation over the question of inter-se seniority between the direct recruit and promotee Section Officers.

2. In consideration of the above facts, extending the benefit of notional fixation of pay to CSS Grade I officers on their promotion to the Selection Grade from the lit July of the Select  List year. which is the date for counting approved service in all grade of CSS, was allowed till the Select List Year 2007. 2008 was a no panel year for promotion to the grade of Deputy Secretary. For the Deputy Secretary Select List years 2009 and 2010, no such benefit has been extended.

3 The Office Order issued by CS Division promoting the CSS Grade I officers against 
DSSL 2009 specifically mentioned that the pay and allowances of the officers are to be fixed under FR 22 (1) (a) (i) w.e.f the date of taking over the charge of Deputy Secretary on regular basis. No separate instructions for fixation of pay on a notional basis from 1ST July. of the Select List year in respect of officers who have been included in DSSL 2009 or DSSL 2010 have been issued

4 It has, however, come to notice of this Department that some of the Ministries/Departments have fixed the pay of Grade I Officers of CSS on their promotion as Deputy Secretaries against DSSL 2009 and 2010 notionally with effect from 1/7/2009 and 1ST July. 2010 respectively, which is not consistent with extant rules on the subject and without any specific instructions in this regard by CS Division of DOP&T. All the Ministries/Departments are, therefore, requested to review the cases of fixation of pay of Grade-I officers ( Under Secretaries) of CSS on their promotion to the Selection Grade (Deputy Secretary) against the Select List years 2009 and 2010 and take steps to rectify the pay fixation in those cases where the benefit of notional fixation of pay has been incorrectly extended.

Enhancement in the rate of Qualification Pay from Rs.60/- to Rs.120/- per month



Auditors and Accountants in the Indian Audit and Accounts Department and certain other organised accounts cadres and clerks Grade II in the Railways accounts department are now getting qualification pay of Rs.60 per month.

The Ministry of finance in its recent office memorandum has revised the qualification pay from Rs.60 per month to Rs.120 per month with effect from the date an individual elects to draw in the revised scale of pay under CCS (RP) Rules, 2008.

The Office Memorandum dated 13.01.2012 issued in this regard is reproduced below.

SUBJECT:- Enhancement in the rate of Qualification Pay from Rs.60/- to Rs.120/- per month consequent upon the revision of scales of pay on the recommendations of the Sixth Central Pay Commission.

The undersigned is directed to refer to this Ministry’s O.M.No. 9(7)-E.III (A)/98 dated 5th August, 1999 regarding the rate of qualification pay of Rs.60/- p.m. to the Auditors/Accountants in the Indian Audit & Accounts Department and certain other organized accounts cadres and the Clerks Grade II in the Railway Accounts Department. The matter regarding revision of the rate of this qualification pay consequent to revision of scales of pay on the basis of recommendations of the Sixth CPC has been under consideration of the Government for sometime past. The President has now been pleased to decide that the rate of qualification pay may be enhanced from  Rs.60/- to  Rs.120/- p.m. with effect from the date an individual elects to draw pay in the revised scale of pay under CCS (RP) Rules, 2008.

2. The qualification pay shall continue to be treated as part of the pay for the purpose of fixation of pay on promotion to the next higher post.

3. In so far as persons serving in the Indian Audit & Accounts Department are concerned, these orders have been issued after consultation with the Comptroller & Auditor General of India.

Stepping up of pay of senior member of All India Service vis-à-vis pay of his junior in the cadre

Subject: Stepping up of pay of senior member of All India Service vis-à-vis pay of his junior in the cadre — regarding.

Sir, 
I am directed to say that references from various State Governments regarding anomalies in the pay of senior members of All India Services vis-a vis pay of their juniors in the cadre who have been promoted to the Service or to a higher grade in the Service subsequent to the seniors, have been engaging attention of this Department.

2. The matter has been examined with reference to the existing instructions of the Government on this subject and it is stated that such anomalies on account of fixation of pay on promotion, including the promotion from State service to All India Services, can be solved by stepping up the pay of the senior member of Service at par with the pay of the junior in the cadre from the date when the anomaly arose, subject to fulfillment of following conditions:

(j) Both junior and senior should belong to the same cadre both in lower and higher grade. In the case of anomaly in the pay of officers promoted from State service to IAS/IPS/IFS in a State cadre, both junior and senior should belong to same cadre in the State Service (lower grade).

(ii) Anomaly must have arisen as a result of fixation of pay either on promotion from one grade to another in IASIIPS/IFS or on promotion from State service to IAS/IPS/IFS, as the case may be.

(iii) Posts in higher and lower grade must be identical and in lower grade senior must not be drawing less pay than junior for whatsoever reasons For example if the junior officer draws higher rate of pay than the senior in the lower post or State service post by virtue of advance increments or on any other account, the above provisions will not be invoked to step up the pay of the senior officer.

Subject: Clarifications regarding pay fixation of existing Group `D’ Employees in the revised pay structure.

Attention is invited to Railway Board’s letter of even number dated 12.01.2009 wherein clarifications were provided regarding various aspects of placement of the existing Group ‘D’ employees in the revised pay structure.

2     As per the clarification at Sl.No.1 of Railway Board’s letter dated 12.01.2009, those regular Group `D’ employees who did not posses the minimum qualification and who have retired/died in harness between 01.01.2006 and date of notification of Revised Pay Rules, 2008 will be granted pay band -IS and the grade pay corresponding to their pre-revised pay scale as notified in Railway Services (Revised Pay) Rules, 2008.

3. The aforesaid issue was raised in the 46th Ordinary Meeting of the National Council (JCM) held on 15 May, 2010 and the Staff Side had requested that the cases relating to the non-matriculate class IV employees who retired or died between January 2006 and the date of Notification of Revised Pay Rules, without any re-training be re-considered and such employees should be granted the benefit by re-fixing their pension/family pension at par with those employees who were retrained and whose pay was fixed in PS-1 with grade pay of Rs.1800/-.

4.     The request of Staff Side on the subject has been considered by the Government and it has been decided that the regular Group ‘D’ non-matriculate employees who died in harness or have retired between 01.01.2006 and the date of notification of Railway Services (Revised Pay) Rules, 2008, i.e. 04.09.2008, from the Railways would also be placed in PB-1 with grade pay of Rs. 1800 with effect from 01.01.2006. It should however be ensured that if any non-matriculate regular Group `D’ employees have been on leave due to which they could not be retrained, they should be retrained immediately on joining duty.

In pursuance of the OM NO. 7/ 14/2010-EIII(A) dated 5th July, 2010 issued by Ministry of Finance, Department of Expenditure regarding exercise of option to switch over to the revised pay structure from a date later than 1/ 112006, I am directed to convey the approval of the Central Government to
make the provisions of the said O.M. applicable to the Members of All India Services in their respective State cadres.

2. The members of All India Services may be allowed re-option, if beneficial to them, for futation of their pay in the revised pay structure from a date subsequent to 1 / 112006 in terms of the provisions contained in sub-rule (E) of Rule 3(A) of IAS(Pay) Rules, 2007 as amended vide IAS(Pay) Second Amendment Rules, 2008, upto 311 12/2010.

Fixation of Pay in merged grades for working on ad-hoc basis on ex-cadre posts in Construction Organisations.

Sub: Fixation of Pay in merged grades for working on ad-hoc basis on ex-cadre posts in Construction Organisations.

      As per Rule (7) of RS(RP) Rules,2008, initial pay of a Railway servant shall be fxed separately (i) in respect of his substantive pay in the permanent post on which the employee holds a lien and (ii) in respect of his pay in the Officiating post held by him. 

2.     As per note 5 below Rule 7 of RSRP Rules, 2008, Where a Railway servant is holding a permanent post and is officiating in a higher post on a regular basis and the scales applicable to these two posts are merged into one scale, the pay shall be fixed under this sub-rule with reference to the officiating post only and the pay so fixed shall be treated as substantive pay”. 

3.     Clarifications are being sought by the zonal railways regarding fixation of pay of staff working in Construction Organisation on ex-cadre posts on ad-hoc basis in merged grades. The matter has been examined and it is clarified that in the case of staff working in Construction Organisation on ex-cadre posts on ad-hoc basis, their pay in the 6th CPC pay structure is to be fixed separately for cadre post and ex-cadre post as provided in Rule 7(1) of RSRP, 2008. Note 5 below Rule 7 is not applicable in their case. 

4.     This issues in consultation with Establishment Directorate and with the concurrence of the Finance Directorate of the Ministry of Railways. 

5.     This disposes of CAO (Const. & MTP), Southern Railway’s letter No.P-5241/I/P/CN dated 12.08.2009 and Southern Railway’s letter No.P(R)524 dated 31.0.2009.

Sir,
I am directed to say that reference from State Governments for clarification on fixation of pay of the members of All lndia Service on promotion to HAG scale on exercise of option under sub rule (8A) of rule 4 of the IAS (Pay) Rules, 2007, as amended vide IAS (Pay) Fourth Amendment Rules, 2010, have been engaging attention of thisDepartment. The matter has been examined and it is clarified that'

(i) For purpose of calculation of two increments (One annual increment and the other as promotional increment) on 1st  July as provided under the sub rule (8A) of rule 4 of the IAS (Pay) Rules, 2007, the basic pay prior to the date of promotion shall be taken into account

(ii) Further, these two increments shall be added to the basic pay of the concerned members of Service as fixed on the date of promotion to HAG scale by adding an amount of Rs.2000/-.
